Bristol man denies attack with glass bottle outside pub

A Fishponds man was dragged on to a road and hit over his head and back with a glass, a jury heard.

Bristol Crown Court was told Daniel Hatherall attacked Daniel Holly outside the Van Dyck Forum pub, after seeing him at the premises.

Outside, on Fishponds Road, Hatherall lashed out with the glass, leaving Mr Holly covered in blood and needing stitches, the court heard.

Hatherall, 24, of Stapleton Road, has pleaded not guilty to wounding with intent to cause grievous bodily harm, as well as an alternative charge of unlawful wounding, on December 28 last year.

Robert Duval, prosecuting, said Mr Holly lived in Pennyroyal Grove, Fishponds, and had fallen out with neighbours in the road.

He said: "There had been a number of incidents in the road and police had been called on a number of occasions by members of both sides."

Mr Duval said Hatherall was a friend of the people Mr Holly had fallen out with.

He said that on December 28 last year Mr Holly, his partner and three of their friends had visited several pubs before going to the Van Dyck, which stayed open late.

He told the court: "The group of five went in. They stood at the back of the pub and 20 minutes after they arrived at the pub the defendant attended.

"The atmosphere between them was uncomfortable, it soon deteriorated and the defendant stared at Mr Holly, trying to provoke and intimidate him."

The court heard Hatherall approached the group, there was a heated exchange, and after words from the manager Mr Holly's group left.

Mr Duval said that outside, when Hatherall and Mr Holly were in the road, causing cars to stop, Hatherall smashed the glass over his head and back.

Hatherall's fingerprints were found on shards of glass recovered from the scene, which had Mr Holly's blood on them.

The court also heard Hatherall was picked out as the attacker from a video ID parade.

He said "absolutely nothing" when interviewed by police, Mr Duval said.

Mr Holly told the jury that when Hatherall and his friends came into the Van Dyck his group kept well away from him.

He said he and his group left the pub, and when they were outside he heard glass smashing on the ground before he turned and Hatherall attacked him with what he thought was a bottle.

He told the court: "I got dragged out into the road by the scruff of my neck.

"It was Danny and he started shouting when he had hold of me. I don't recall what he was shouting.

"He held me head down and he was smashing the bottle on the back of my head. He hit the back of my head five to six times before the bottle broke."

Mr Holly said that after the attack Hatherall ran back towards the pub.

He confirmed he had nine staples inserted to head wounds and 10 stitches to two wounds on his back.

He denied that his group was threatening to Hatherall and trying to provoke a fight.

His partner echoed his account of the attack and said it left him "shaken, bloody and hysterical".
