Second judicial review into Ashton Vale stadium is given the green light
The future of the proposed new Bristol City stadium at Ashton Vale could still be in jeopardy after a second judicial review was granted by the High Court.
On Monday, the anonymous resident behind the first review wrote a letter to the court to say he was withdrawing his application and refused permission for a replacement.

However, today another review has been granted into Bristol City Council's decision to partially turn down a bid to make Ashton Vale a town green, paving the way for the 30,000-seat football stadium.
Judicial reviews normally must be submitted within three months of the decision which is being disputed.
But Judge Anthony Thornton has allowed the second review to take place – despite the fact that the stadium was initially granted planning permission in 2009.
An independent inquiry later said the land should be made a town green.
Campaigners fighting to stop development at Ashton Vale claimed that the resident behind the first review – who cannot be named for legal reasons – had dropped the case because of harassment.
However, the Evening Post has reported that in a second letter to the court he makes it clear he was not persuaded or coerced into withdrawing his challenge.
Following the news of the second review, lawyers acting for anti-stadium protesters said: "Clearly, reports of the demise of the judicial review of Ashton Vale were premature."

“I ploughed through all the comments but none addressed the issue which is before the court. This is whether the decision of BCC was lawful.”

“This development will go ahead, anyone with any sense can see that. Even if this decision is upheld, once the judge has heard both sides of the story, and then even if the claimants actually win it, it is STILL likely to go ahead in one way or another.
All these Gas idiots make me hope they encounter a similar bunch of kill joys when the university builds its stadium in south glos.”

“This really has gone beyond a joke!. Once again we had this disgraceful rag triumphantly proclaiming that the objection had been dropped, the JR was dead in the water, and as far as they were concerned the bulldozers were on standby. Talk about partisan, one-eyed unbalanced journalism.
I suppose we shouldn't expect anything else, given the standard of the reporting on this whole fiasco since Sir Steve first announced his royal decision to build the stadium. One would have thought, given their rescources, the BEP would have at least looked into the legal situation thoroughly and with some detachment before bursting into print in such strident, confident terms.
Once again I would caution that the legal position has to be tested and examined to its conclusion. The council, with their legal department ought to know this but no, once again they've managed to make themselves look foolish and irresponsible. Talk about going off half-cocked!
If the correct procedures have been followed City will get their new stadium. If not, they wont, it really is that simple. This has turned into a circus of monumental proportions, other cities must be laughing their socks off at us.
Time to draw a deep breath and stand back I think.”

“@Rosset
TVGers, bless em.
There are loads of people in this country with real problems. If the worst it gets for you is where you can't walk on some waste ground on your day off, then you haven't actually got it so bad.
Rather easy to do that and equally as true.
But maybe we can actually look at some facts:
This season, lowest attendance at Ashton Gate - 12018
This season, highest attendance at Ashton Gate - 16346
http://tinyurl.com/83unekq
Let's keep it simple and conservative £20 per ticket - BCFC brought in a minimum of £240000
In addition, all the traders who operate in the area benefit from increased footfall e.g. the pubs, the fast food outlets, the shops, petrol stations etc.
This is revenue generation and jobs for someone. In addition, BCC benefit from tax revenue and so does the Inland Revenue.
Please bear in mind, this is only every other week (keeping it simple) during the football season.
This is Bristol City only as I'd like to keep it simple just for you (scale it up to the national scale, well that just wouldn't be relevant would it?)
Please enlighten me.
Just what benefit does a TVG bring to South Bristol?
Football fans, yep your right, bless 'em. They pay their way (indirectly through their patronage of football games) to helping the less off. They help local businesses on match days. They'd be missed if they went elsewhere.
The same can not be said about someone walking his/her dog?”

“Just 13,000 supporters eh! Well that makes us quite a minority doesn't it...we should fit just nicely in a country where minorities rule...
For years no development was forthcoming because both Bristol clubs were dependant upon public money...this is pretty much about private investment, that will benfit more than just "football fans".
It's funny how certian people feel oh so relaxed about sterotyping football supporters in such a way they would never dare any other group within our society.
For once BCC can be belatedly congratulated in their views on this matter and before any Rovers fans result to tribalism, just remember this is a great test case for you to use as you strive for your development. Sometyhing I sincerely hope you achieve and in as quick a time as possiable. Yes its about football, but its also about much more than that, its only those who are to selfish to remove the blinkers that can't see it.”

“It's sad that we live in an age in the UK when the system is so easily abused by a little football club.
We are the laughing nation of the world at present because our system is so woolly that the worst people in society are making £1m's out of their crimes, immigration is a complete and utter mess and now less than 13000 supporter shout the loudest when we live in a city of 500000, how sad it it when they accuse the judge of being a Bristol Rovers supporter? This is all about one team's supporters forcing their views on every one else and nothing else. Pathetic little people.”

“I cannot believe how our legal system works - it is like the most corrupt days of ancient Rome with nameless people swapping law suits against people they don't like at the drop of a hat. What ever happened to the adage about justice being seen to be done. If someone hasn't the courage to stand up and be named then their appeal shouldn't be heard, especially if they're scrounging off ordinary tax payers to pay their bills. What an amoral, cowardly, individual.”
