“@Ourbads
Compltely wrong i'm afraid. "Theft by finding" is a crime.

If the property hasn't been abandoned then it is theft wherever you find it.”

“Any reason why the owner/police hasn't called their number or had the phone blocked?”

“Ourbads, the incident happened on 30th September and the story came out on the 10th I think its safe to say that he has had enough time to hand it in to the police, so yes it can be considered theft.
It would also be interesting to know why he didnt hand it in to Mcdonalds staff”

“this article should be highlighting the stupidity of people leaving things around the place - hardly theft is it.
Different story if he saw the person leave it and waited for them to leave before picking it up though!!”

“It was a genuine question.
I just think it is a bit strong for The Post to state that it was "theft" in the circumstances, and legally, I'm not even sure if it is.
Referring to McDonalds as a "restaurant" is a bit of a stretch too”

“If you find something unattended in a public place and pick it up, is it theft? Maybe he is going to hand it in?”
