COUNCILLORS will almost certainly abide by an independent inspector’s recommendations on the future of Ashton Vale, where Bristol City FC wants to build its new stadium.

They will be told that to do otherwise would probably be consigning Bristol City Council to another long and expensive legal wrangle over the future of the site.

A new public inquiry is expected to be held after the council sensationally decided a few weeks’ ago to stop defending a legal challenge on part of the site which remains unregistered as a town green.

The decision, which was taken by councillors one year ago, effectively meant that the club could go ahead with its plans to build a new £92 million stadium.

But a pressure group called SAVE which was set up after the decision, took legal action to challenge the move.

They were furious that councillors made up their minds without new evidence being challenged under cross-examination at a public inquiry.

The football club itself gathered lots of new evidence after independent inspector Ross Crail made her recommendations following the first inquiry.

She urged the council to register the entire 42-acre site as a town green and therefore ruling out any development on the land.

But the council decided against referring the new evidence back to her before making a final decision.

Lawyers for the pressure group began proceedings in the High Court and the council asked for them to be quashed after a resident who signed the legal papers decided to withdraw.

But the judge decided that a full hearing should go ahead.

This led to the council’s shock decision to pull out from the legal dispute and means the long-running saga is effectively going back to square one.

It is not yet clear whether the new public inquiry will be taken by Miss Crail or a new inspector will be chosen instead.

Some experts believe that it would be best for someone with a deep knowledge of the issue to consider any new evidence.

But there is a counter argument that it would be better if the case was dealt with completely afresh.

A council spokesman said: “The matter is still before the court and the final decision on the referral back to the Inspector lies with the court. We hope to hear shortly.

“It is far too premature to imagine what the Inspector's recommendations will be, though it would be reasonable for the Public Rights of Way Committee to follow such recommendations unless there are grounds not to.”

    My qualifications, academic background, where I live, how long I've been campaigning, my 'bleating' about being picked on - all these have been used systematically by BCFC Finker but none are related to my motives or to the TVG or closely related issues. Now, I've not brought any of these up originally so what's going on here if its not an attempt to keep having a go at a character? I've no objection to personal criticism if its relevant but what I see mostly is not.

    If you'd like to quote where I've criticised other people's motives I will tell you why, though I have to say that I do my best to stay on either the issue in the story, or closely related issues or that fact that someone is strayng from the main issues and/or departing from genuine, reasonable debate. That's the way I most often comment on this site and write on my blog. Trace back my comments and those of BCFC Finker and you will see the differences.”

    More Spanish Inquisitition, 'surprise and fear' in this case not being your chief weapon, since I'm neither surprised at your comment nor in fear! Debate on the actual issue finished a while back. Mind you, you may have ruthless efficiency in having a go in this way at character and as for fanatical devotion, well I'm sure that being 'anti-TVGer' does really get you going.     I see you didn't attack my points about the convenience of anonymity, instead choosing to avoid the subject with talks of conspiracy.

    You've got green qualifications, teach it, have lived in Knowle for 50 years and now reveal you've been doing green for over 30 years. Achievements that can be applauded but nothing to do with a TVG. You've complained previously that you raised issues with BCC about this and they didn't listen. Having seen your pontificating, I'm not surprised.

    Your right about the TVG, it doesn't exist because BCC abandoned it's decision, so we wait on further legal wrangling.

    Now to the crux of the matter. With all your expertise (especially your academic side), you'll know that to prove something, you look at the evidence from all angles, you give it a prod, basically you give it a hard time. When evidence stands up to such rough and tumble examination, it might 'indicate' an element of truth and go some way to proving something. Now I'm aware that greens don't like this rough and tumble examination of their evidence and it it would appear that you don't like the TVG evidence being given a prod either (along with TVGers). Is it little surprise I attack your way of thinking.

    As to attacking your personally, I don't even know you. Mind you, I suppose that if you don't like anyone looking too closely at the evidence, what better way to avoid scrutiny than bleating "...look he's picking on me...", "...look he's a conspiracist..." blah blah blah.”

    “@ BCFCFinker - there is no genuine argument in your latest comment, only a largely irrelevant attack on the person (me) whose opposing argument you've given up on trying to show as unreasonable (if tyhat is ever your aim).

    Its not a question of me being green 'at the moment' because I've been arguing for my green view for just over 30 yrs. Its also not a matter of doing it because I want to be seen doing it either because most green activity I undertake I make no attempt to publicise - and I'll argue a case because I think its right not because its popular or unpopular.

    The site you say is a TVG site is not in fact a TVG site as such - its the site of a political opponent (I'd say from the other end of the political spectrum) so its no surprise that certain kinds of green policy are not welcome there. There are a range of 'TVG sympathetic' sites in any case, some more welcoming than others.

    As in all political parties there are those keen on conspiracy theories. What they all have in common is an over-reliance on some sort of ideology, be it left wing, right wing , green or whatever. I'm not the type to defend any of that rubbish.The point I made about you is your tendency to abandon reason for conspiracy theory on the TVG/green belt/BCFC stadium issue. This is highly relevant to the debate because your ideology simply ignores or skews the evidence and rationale.”

    As to conspiracies, the greens probably know more than most about those things, so I'll defer your expertise. After all, you like letting everyone know about your green qualifications as obviously they qualify you to talk authoritatively when people point out holes in your green arguments or that you live in Knowle (for 50 years no less) and therefore can talk authoritatively about Knowle West (after all, they are the same aren't they?) if someone disagrees with you.

    Real world, ummm, I bet you've got a qualification on that as well.”

    I ignored your point about which party I've have in the past contested several elections for because it is totally and completely irrelevant to absolutely any points of rational debate on this issue. I was trying to stay on the point. However...sigh...since you ask it was the Green Party (surprise, surprise - after all its not as if you cant find this out by simply clicking on green_man and Googling Vowles the Green).     On your second irrelevant point - you are telling a person who have lived first in Knowle West then in Knowle, a short distance away, for 50 yrs that they aren't the same place! Well done. Thousands of people live in Knowle West so the idea that PE175 from Knowle West has absolutely no-one in agreement must be rubbish (as I said before I can think of a dozen people I know who would be in agreement).”
