Bristol murder trial witness tells of stabbing
A witness has told a murder trial of the moment he saw a Bristol man stabbed.
Jason O'Daly said John Derrick and Bradley Payne were arguing in Gatehouse Avenue, Bishopsworth, and Payne started to cycle away.
He told the jury that, when Mr Derrick said he would fight one-on-one, Payne put down his bike, came back and plunged a blade into Mr Derrick's chest and left eye.
Payne, aged 32, of Witch Hazel Road, Hartcliffe, denies murder in July last year.
He also denies making a threat to kill and unlawfully wounding another man, Aaron Bennington, a month previously.
Mr O'Daly said he had seen Payne and Mr Derrick having an argument in the street.
He told Bristol Crown Court: "I noticed a cut on John Derrick's nose. I heard John saying, 'I didn't call your dad this, I didn't call your dad that.'
"Bradley turned off on his bike and John said something to him.
"It was, 'If you want a fight, I'll fight you one-on-one.'
"Brad put down his bike and went towards Johnny. Johnny said, 'No weapons', and then Brad plunged Johnny with a knife."
Mr O'Daly said Payne produced the large stainless steel blade from behind his back.
He described how he first stabbed Mr Derrick in the top of the ribs and then in the left eye.
He told the court: "Mr Derrick stumbled to the end of the kerb and basically just collapsed.
"Bradley Payne didn't seem like he cared what he had done. His last words to Mr Derrick were, 'Call the ambulance or police before you die.'"
Mr O'Daly said he then noticed Payne heading towards Innox Gardens.
He later saw him through the windscreen of a green Vauxhall Fontera with blacked-out windows, lying in the vehicle, being driven by a blonde whom he did not recognise.
Jordan Smith told the court he had seen Payne with a knife outside Mr Bennington's flat, and Mr Bennington had leaned out of his window and told him: "You ought to find out the truth before you come accusing people."
Mr Smith said a few weeks later he was in Gatehouse Avenue when he heard shouting, looked up the road and saw John Derrick stumbling on to a van.
When he investigated, he saw blood coming from Mr Derrick's eye and people turned up and phoned for an ambulance and police.
Charmaine Chivers said she was also there and witnessed Mr Derrick collapse to the floor.
She said when she went up to him she could see his eye was bleeding and he was finding it hard to breathe.
Nicky Campbell told the jury he had seen Payne, in an angry mood, stood outside Mr Bennington's flat, holding a kitchen knife.
He told the jury that, a few weeks later in Gatehouse Avenue, he saw Mr Derrick and Payne, and Payne made a quick motion towards Mr Derrick.
He didn't know whether the motion involved just use of his hand, or a knife.
Kevin James, also known as Cricket, told the court he had seen Mr Derrick on the day of the stabbing and he thought Mr Derrick was returning home before he found him lying on the ground injured.
The case continues at Bristol Crown Court.
