A doorman who gunned down two gangsters in Bristol has been told new evidence in his case can be put before the Criminal Cases Review Commission (CCRC).

Mohammed Nasir Khan was convicted of murdering Errol Sharpe and David Hamilton at Bristol Crown Court in February 2002 and jailed for life. Last year, his tariff was set at a minimum of 19 years.

The three men had come to blows in Stapleton Road, Easton, in February 2001, after Mr Sharpe and Mr Hamilton demanded £10,000 from Khan under threat of death.

He told them he had the money at home and drove the 31-year-olds in his silver Toyota to a cul-de-sac in Stoke Bishop, before getting out of the car and turning a gun on them.

Former Triangle Snooker Club doorman Khan fired 12 bullets in rapid succession, hitting Mr Sharpe with seven and Mr Hamilton with four. But he said he had snatched the gun from Mr Sharpe and used it in self-defence.

Khan, of Tunstall Close, Stoke Bishop, tried to appeal against his conviction but failed, then took his case to the CCRC, the independent body that investigates suspected miscarriages of justice.

In August last year the CCRC said it would not take his case any further.

But his barrister, Fred Ferguson, appeared before Lord Justice Thomas and Mr Justice Silber at the High Court on Tuesday and argued the CCRC's decision was wrong, and they should be ordered to look again at the case.

He told the judges fresh evidence had come to light, which put into question some of the key evidence at Khan's trial.

Lord Justice Thomas said the CCRC's decision had to be viewed in the light of the material they had before them at the time – and that did not include the fresh evidence.

He said: "The proper course must be for Khan to put the further information before the commission and await their decision on that point."
